Warranty Statement

By buying, using and/or installing the British Acoustics Product, you are agreeing to be bound by the terms of the British Acoustics Hardware Limited Warranty. (”Warranty”) is as set out below. Do not use your product until you have read the Terms of the Warranty.
 

What is covered by this Standard Limited Warranty?
British Acoustics warrants hardware products and accessories, manufactured by or for the British Acoustics brand (“British Acoustics Product”) that are purchased from a British Acoustics - authorised dealer against defects in materials and manufacture for the applicable period described below (the “ Warranty Period”).

Warranty Terms and Conditions:
• Products must be purchased from a British Acoustics authorised dealer.
• Warranty period begins from the invoice date of purchase. Proof of Purchase is required for warranty validation.
• British Acoustics provides the above stated manufacturer’s warranty unless local regulations prohibit.
• Registration with British Acoustics is required in ALL countries and must be completed within 30 days of purchase.
• This does not affect your statutory rights.


Visit www.britishacoustics.com for changes or updates to this warranty table. The preceding warranty periods begin on the date of purchase from a British Acoustics - authorised dealer, as documented by invoice, receipt, or other acceptable means. The unexpired portion of the warranty may be transferred to a subsequent purchaser upon re-registration with British Acoustics. British Acoustics Warranty service is only available in the country or region of the products’ original purchase. British Acoustics, its distributors, dealers and authorised service centres are under no obligation to perform warranty service on products purchased in other regions. The British Acoustics Product may be returned to the country of purchase at your expense. To the extent that national, state, provincial or territorial law applicable to your purchase of the British Acoustics Product require a seller to provide additional warranty rights,
British Acoustics provides those warranties required under applicable law.


Register your Product -  By registering this British Acoustics Product at British Acoustics’s website within thirty (30) days of the date of purchase, YOU MAY BE ELIGIBLE TO RECEIVE AN EXTENSION OF THE STANDARD WARRANTY as described in the table above. Also, registration will facilitate processing any warranty claim that may be necessary.


How do I extend this Warranty on eligible products?
For purchasers who register their British Acoustics Product at British Acoustics’s website within thirty (30) days of the date of purchase,
British Acoustics will extend the warranties for new British Acoustics Products for the periods stated in the table above. This extended warranty does not apply to fans or digital displays. You can register your British Acoustics Product at: www.britishacoustics.com

 

What is not covered by this Warranty?
This warranty does not apply to any non-British Acoustics branded hardware products or any software, even if packaged or sold with a British Acoustics Product(s). Manufacturers, suppliers or publishers other than British Acoustics, may provide their own warranties to you, but British Acoustics, in so far as permitted by law, provides the associated software included with their British Acoustics Products on an “AS IS” basis. Software distributed by British Acoustics, with or without the British Acoustics trademark, is not covered by this limited warranty. The licensing agreement accompanying any included software contains the details of your rights with respect to its use.

This warranty also does not apply to the following:
a. Damage caused by improper use, care, or maintenance or failure to follow the instructions and/or maintenance and repair recommendations contained
in the User Manual, or at wwwbritishacoustics.com
b. British Acoustics Product that has been modified to alter its functionality or capability without the written permission of British Acoustics,
c. Consumable parts, such as batteries, unless failure has occurred due to a defect in materials or manufacture,
d. Damage caused by accident, abuse, misuse, exposure to liquids, fire, earthquake, acts of God, or other external causes,
e. Damage caused by operating the British Acoustics Product outside British Acoustics’s published guidelines,
f. Damage caused by service (including upgrades and expansions) performed by anyone who is not an authorised representative of British Acoustics (including attempts to “hack” or modify firmware or software)

g. Cosmetic damage, including scratches, dents, and broken plastic,
h. Conditions caused by normal wear and tear or otherwise due to the normal aging of the British Acoustics Product,
i. Damage caused by use with another product,
j. Product that was purchased from an unauthorized seller or online vendor, or
k. Product on which any serial number has been removed, altered or defaced.

Legal Disclaimers, Exclusion of Other Warranties and Limitation of Liability
The preceding warranties are the exclusive warranties given by British Acoustics for the British Acoustics Product and supersede any prior, contrary or additional representations, whether oral or written. British Acoustics and its distributors, jobbers, and dealers DISCLAIM AND EXCLUDE ALL OTHER WARRANTIES—WHETHER EXPRESS, IMPLIED, OR STATUTORY—INCLUDING ANY WARRANTY OF MERCHANTABILITY, ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE , AND ANY IMPLIED WARRANTIES OTHERWISE ARISING FROM COURSE OF PERFORMANCE, COURSE OF DEALING, OR USAGE OF TRADE.


If the British Acoustics Product fails to conform to the preceding warranties, you must notify British Acoustics or its authorised dealer within a reasonable time and in no event more than fifteen (15) days after the discovery of the nonconformity and deliver the British Acoustics Product, together with proof of date of purchase, to the original point of purchase, a British Acoustics factory, one of British Acoustics’s authorised service stations, or an authorised British Acoustics International Distributor via pre-paid transportation. British Acoustics will investigate and, in the event of a breach of warranty, will provide, at its sole option and within a reasonable


period of time:
• repair of any nonconforming British Acoustics Product or components;
• replacement of any nonconforming British Acoustics Product or components with conforming product or components; or
• refund of the lesser of either the current value of the product at the time the warranty claim is made or the purchase price.

 

When providing repair or replacement service, British Acoustics will use reasonable efforts to reinstall the product’s original software configuration and subsequent update releases, but will not provide any recovery or transfer of software or data contained on the serviced British Acoustics Product unit not originally included in the British Acoustics Product. Repaired or replacement products will conform to the warranty for the unexpired duration of the warranty period for the original, nonconforming British Acoustics Product. British Acoustics may use used or repaired material for all warranty claims. This remedy does not cover any labor charged or travel time incurred by you for diagnosis, removal, or reinstallation of the British Acoustics Product; the cost of transportation of the British Acoustics Product to or from Purchaser; or any other contingent expenses. THE REMEDY SELECTED BY British Acoustics IN ACCORDANCE WITH THIS PARAGRAPH SHALL BE THE EXCLUSIVE AND SOLE REMEDY FOR ANY BREACH OF WARRANTY.


BRITISH ACOUSTICS SHALL NOT BE RESPONSIBLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY—WHETHER RESULTING FROM NON-DELIVERY OR FROM THE USE, MISUSE, OR INABILITY TO USE THE PRODUCT OR FROM DEFECTS IN THE PRODUCT. THIS EXCLUSION COVERS, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, REVENUE OR PROFIT, COST OF SUBSTITUTE EQUIPMENT, LOSS OF OR DAMAGE TO ANY DATA, AND CLAIMS BY PURCHASER’S CUSTOMERS OR OTHER THIRD PARTIES.


This Warranty is governed by the laws of the State of Delaware, excluding the application of its conflicts of law rules. The U.N. Convention on Contracts for the International Sale of Goods will not apply to this Agreement.


If any part of this Warranty is found to be void or unenforceable, then the remainder shall have full force and effect, and the invalid provision shall be partially enforced to the maximum extent permitted by law to effectuate the purpose of the Warranty.
 

Export Control. You may not use or otherwise export or re-export the British Acoustics Products and associated software except as authorised by United Kingdom law and the laws of the jurisdiction(s) in which the British Acoustics Products and associated software were obtained.You also agree that you will not use the British Acoustics Products and associated software for any purposes prohibited by United U.K. law, including, without limitation, the development, design, manufacture or production of missiles, nuclear, chemical or biological weapons.


Government End Users. The British Acoustics Products and associated software and related documentation are “Commercial Items”, as that term is defined at 48 C.F.R. §2.101, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation”, as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to any U.K. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein. Unpublished-rights are reserved under the copyright laws of the United Kingdom.
